Dear Carole,
I received your response to my request for a CDP appeal on my 2007 taxes. Your determination is correct: My disagreement IS a “moral, religious, political, constitutional, conscientious, or similar objection to the payment of federal taxes that reflect a desire to delay or impede the administration of federal tax laws.”
Since you are threatening me with a $5000 penalty if I don’t withdraw my hearing request, what choice do I have? That is usually called blackmail and I resent it. I would like to address the issue of this being a “frivolous” or “desire to delay” issue, prior to withdrawing my hearing request.
My hearing request was based on a moral objection to the commission of war crimes, crimes against humanity, and crimes against peace of the Bush administration, such as pre-emptive war (Iraq), massacre of civilian populations, torture, rendition for torture, use of indiscriminate weapons of mass destruction (depleted uranium), and assassinations without due process of law. There is no question these crimes took place, the only question is how to deal with it.
Dictionary.com definition of frivolous:
Of little or no weight, worth, or importance; not worthy of serious notice: a frivolous suggestion. Do you think war crimes are “frivolous”? I reject that characterization of my objection.
“desire to delay or impede the administration of federal taxes”. Yes, my intention is not only to delay or impede the administration of federal taxes, but to prevent them from being collected at all. I would rather go to jail than pay federal taxes.
If the CPD process cannot be used to address these crimes, and the entire US political system failed to hold these criminals accountable, then what can I do to deal with my responsibility as an American citizen for these crimes? Please give me an alternative to the CDP process.
I know you are just doing your job, but consider your role in collecting the taxes that allowed our government to commit and continue to commit war crimes. Adolph Eichmann said he was just doing his job and he was hung. Are you a careerist (see article) or are you a human being?
I withdraw my hearing request on condition you provide me with an alternative to this process to address my objection to the use of my tax money for war crimes. I would rather go to jail than pay you the $1,476.88 that I owe the IRS.
I challenge you to reflect on your role as an enabler of a government that now claims the right to assassinate anyone, anywhere on earth, at any time, with no due process of law including American citizens. Do you support this? If not, then why don’t you resign your job? Every single person is responsible for the behavior of our government. Everyone has to take responsibility or no one will, and the politicians certainly won’t do anything.
I will continue to use every available means to prevent you from taking my money for use by the criminal US government. Please join me in returning the US to a peaceful and law abiding society, instead of the murderous and lawless empire that it has become.
Sincerely,
Gary Flomenhoft
